Milton Yarberry, City Marshal

Description: George Myersn Jr collection image of Milton Yarberry as the first City Marshal of Albuquerque, New Mexico in 1880. He had been an outlaw in the 1870s with his friend Dave Mather. Killed Harry A. Brown in Albuquerque in 1881. Some powers that be in Albuquerque did not like Yarberry because he was a top gunman. They tried to have Yarberry convicted of this killing but it was proven it was a just kill in the line of duty. In June, 1881, Yarberry killed Charles D. Campbell in the line of duty. It was proven that Campbell was armed and the gun had been fired but the prosecution (supported by high members of Albuquerque citizens) found one "witness" to dispute that Campbell pulled his gun. Yarberry was railroaded, sentenced to death and hanged  in 1882. Just before he was hanged he stated, "Gentleman, you are hanging an innocent man." His innocence was always supported by Sheriff Armijo. This is one of the finest images extant of a known Western lawman. It is on a par with the known image of Ben Thompson as City Marshal of Austin, Texas.
